Manslaughter

Manslaughter 是一个法律术语,指非法杀害他人,但缺乏预谋或恶意。

  1. Voluntary Manslaughter: 故意但在极大挑衅或情绪失控的情况下杀人(激情杀人)。
  2. Involuntary Manslaughter: 由于过失或意外行为导致他人死亡(过失杀人)。
  1. “He was found guilty of manslaughter rather than murder.” (他被判犯有过失杀人罪而非谋杀罪。)
  2. “The driver was charged with vehicular manslaughter after the accident.” (事故发生后,司机被控以交通肇事过失杀人罪。)

无明显前缀或后缀,属于复合词结构。

在英美法系中,murder(谋杀)和 manslaughter(过失杀人)有严格的区别,主要在于是否有“预谋的恶意”(malice aforethought)。

Man(人)+ Slaughter(屠杀)。虽然听起来很血腥,但在法律上它特指那些“非蓄意”的致死行为。

In court, the judge said, “There was no hate, only a terrible mistake.” He was convicted of manslaughter, not murder, because his hand had slipped, but his heart had no evil.
